These Terms of Use govern your relationship with Bytize Technology Solutions Pvt Ltd. and the PosBytz service.
General Terms
These Terms of Use govern the relationship between Bytize Technology Solutions Pvt Ltd. ("Bytize," "we," "us," or "ours") and its customer ("Customer," "You," "Your").
By registering and using the Service, you represent that you are at least 18 years old and legally entitled to accept these terms. The Service includes the PosBytz application, website, online store, and various business features including POS, inventory management, CRM, accounting, HR and payroll, and online ordering systems.
PosBytz reserves the right to amend these Terms at any time by notifying you via email or message. Continued use constitutes acceptance of changes.
Use of Service
Subject to these Terms, PosBytz grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use the Service.
Prohibited activities include:
- Using the Service unlawfully or fraudulently
- Infringing intellectual property rights
- Damaging PosBytz systems or interfering with other users
- Attempting to reverse engineer, decompile, or extract source code
- Using automated methods or bots to access accounts
- Reproducing or reselling the Service
PosBytz Account
You must provide accurate, current, and complete information when registering. You are solely responsible for maintaining account security and confidentiality. Notify PosBytz immediately of any security breaches or unauthorized access.
Service Offerings
The Service consists of:
- Basic Service: Free tier with limited features
- Premium Service: Subscription-based access with expanded functionality
Free trial periods may be offered for Premium Service. If not purchased before expiration, access reverts to Basic Service. Data is retained for 30 days after subscription ends.
Payment
You agree to rates and fees displayed in the application at purchase time. Billing cycles are typically monthly or annual, beginning at purchase or after trial expiration.
No refunds are provided for early cancellation within a billing cycle. All payments must be made without deductions for taxes, which remain your responsibility.
Intellectual Property Rights
PosBytz owns all website content, software, videos, images, and materials. The usage right granted does not constitute assignment of proprietary rights. You may not use PosBytz trademarks, logos, or domain names without prior written consent.
Account Cancellation
PosBytz may cancel accounts at its sole discretion. You may cancel anytime through account settings or by contacting customer support. Upon cancellation, all rights expire immediately. Ensure data backup before cancellation.
Service Provided "As Is"
The Service is provided "as is and as available" at your own risk. PosBytz does not warrant that the Service will meet your specific needs, be error-free, or interrupt-free. You are responsible for maintaining antivirus software and regular backups.
Limitation of Liability
PosBytz is not liable for direct, indirect, incidental, special, consequential, or exemplary damages, including lost profits, business, reputation, or data losses. Maximum liability is limited to usage fees paid in the preceding 3 months.
Governing Law and Jurisdiction
These Terms are governed by Indian law, including the Information Technology (Amendment) Act, 2008. Disputes fall under exclusive jurisdiction of New Delhi, India courts and may be referred to arbitration under the Arbitration and Conciliation Act, 1996.
